Privacy Methodology

PayNet, Inc. an Ontario corporation (“PayNet”) respects your privacy.  This Privacy Statement informs you of our privacy practices and of the choices you can make about the way your personal information is collected online and how that personal information is used.  Because information is our cornerstone, privacy and data protection are fundamental values of our business.

This Privacy Statement does not apply to information regarding corporations, partnerships or other non-individuals, or to information (such as business information that does not reveal anything personal about an individual) that is not “personal information” as defined in applicable privacy laws.

This Privacy Statement does not apply to the practices of companies or other entities that PayNet does not manage or control, including PayNet’s members (each, a “Member”).

The PayNet web sites may contain links to third-party web sites for your convenience and information.  PayNet does not control those sites or their privacy practices which may differ from PayNet’s practices.  PayNet does not endorse or make any representations about third-party web sites.  We are not responsible for the privacy practices or the content of such web sites.

Collection and Use of PERSONAL Information

To serve you better, understand your needs and interests, and deliver a consistent and personalized experience, PayNet may collect, export, and use personal information and other information on web site users (‘information’) with notice and consent given by consenting to the Terms of Use of this Web Site. PayNet will not use any information in a way which would be detrimental to you.

For example, when you order or utilize products or services, request information, subscribe to marketing or support materials or enter contests or participate in surveys, we may ask you to provide personal information to complete these transactions.

The types of personal information you provide to us on these pages may include your name, home address, home telephone number, and home email address; and other unique information such as user IDs and passwords, billing and transaction information, product and service preferences and contact preferences.

In addition to the personal information you provide, PayNet may also collect information that is not personally identifiable during your visit to a PayNet web site through our automatic data collection tools, which may include Web beacons, cookies, embedded Web links, and other commonly used information-gathering tools. These tools collect certain standard information that your browser sends to our web site such as your browser type and language, access times, and the IP address of the web site from which you arrived at a PayNet web site.  PayNet uses this information in order to optimize our web site, personalize and enhance your experience from our web site, and to assess usage of our web site.

A visitor to a PayNet web site, who is not purchasing products or services, is not required to actively reveal any Personally Identifiable Information at all, such as name, home address or telephone number, unless the visitor is requesting further information.

If you choose to use a referral program on our site, we will ask you for your referral’s e-mail address and automatically send your referral a one-time e-mail inviting them to visit the site.  PayNet uses and stores this information only for the purpose of sending this e-mail and to provide referral message blocking, where available.

With respect to any personal information that you provide to us through a PayNet web site, you represent and warrant that you have the authority or have obtained all necessary consents from the subject individuals as are required under applicable privacy laws to provide the personal information to PayNet for the purposes that the personal information is provided.

Commercial Credit Reporting Business – Our commercial credit repository (with data regularly provided by our Member base) is comprised of data on credit performance of commercial businesses.   .  Access to information in this database is limited to authorized PayNet Members who have signed an agreement with PayNet to use PayNet Services in accordance with the PayNet Member (Client) Agreement.

PayNet may collect from its Members and/or discloses to its Members personal information about individuals, provided that such Members confirm to us that they are permitted to share such information, such information is publicly available or the collection is required or authorized by law. This information is solely related to a transaction to assess commercial credit. 

We do not, except where otherwise required or authorized by law, use or disclose personal information unless the individual is aware of the purposes for which the information will be used or disclosed, and has given his or her consent to such use or disclosure. 

In almost all cases where consent is required, individuals will not provide such consent directly to us, but to our Members.  As such, PayNet’s Members must take their own independent measures to ensure compliance with applicable privacy laws, such as by obtaining all requisite consents.  We work with our Members to make them aware of the importance of obtaining individual consent prior to providing PayNet with individuals’ personal information related to a commercial transaction, and prior to accessing the personal information contained in our commercial credit reports.  However, we are not responsible for the personal information practices of our Members.

Protection of Your Information

PayNet takes appropriate technical, contractual, administrative and physical steps to protect against unauthorized access to and disclosure of personal information we collect.  Our employees are required to maintain the confidentiality of confidential or proprietary information belonging to PayNet or its customers and may not disclose such information without appropriate authorization from a PayNet officer. 

We use Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive information such as commercial credit history reports.  This security measure is working when you see the symbol of either an unbroken key or a closed lock at the bottom of your browser window or near the URL (depending on your browser).

PayNet’s primary approved method for accepting client commercial datasets is via our SSL secure file transfer web site.   Please contact us before the unscheduled transmission of any confidential information via our secure web site, e-mail or otherwise.

PayNet will not sell, rent or lease your personal information to others except as described in this Privacy Statement and in the Member (Client) Agreement as it pertains to our Commercial Credit repository.

PayNet may retain service providers and suppliers to deliver products, services and customer solutions and to assist PayNet with marketing and communication initiatives. These providers and suppliers include, for example, email service providers, automated data processors, customer relationship management services, and shipping agents.  Suppliers and service providers are required by contract to keep confidential the information received on behalf of PayNet and may not use it for any purpose other than to carry out the services they are performing for PayNet.

Access To and Accuracy of Your Information

PayNet strives to keep your personal information accurately recorded. We have implemented technology, management processes, and policies to help maintain data accuracy.  PayNet provides individuals with reasonable access to personal information that they provided to PayNet and the reasonable ability to review and correct such personal information or ask for anonymity, blockage, or deletion, as applicable.  Your rights to access your personal information are not absolute.  PayNet may deny access when denial of access is required or authorized by law, when granting you access would have an unreasonable impact on other people’s privacy, to protect our firm’s rights and property, or where the request is frivolous or vexatious.  If we deny your request for access to, or refuse a request to correct personal information, we will explain why.

Communications and Privacy Preferences

Subscription communications include email newsletters, software updates, etc. that you expressly requested, are based on your role, and/or that you consented to receive.  After you request or receive such communications, you may opt out of receiving them by using one of the following methods:

 

Be sure to provide your name, email and postal address, and specific relevant information about the PayNet subscriptions that you no longer wish to receive.

Please be aware that when you opt out of receiving certain subscription communications, it may affect the services you have chosen to receive from PayNet where accepting the communications is a condition of receiving the services. You may also opt-out at any time and request that PayNet remove any Personally Identifiable Information (PII) from its servers by sending a separate email with your request to operations@paynet.com.  

Minor’s Privacy

Our web sites are not intended for the use of minors or anyone under the age of fifteen (15).  We encourage parents and guardians to take an active role in their children’s online activities and interests. Do not use this website unless you are an adult.

Login to PayNet Services

Access to portions of this Web Site are private and require your email address (username) and an associated password which must be kept private, confidential and secret. You are encouraged to routinely change the password and not use the same password as any other website you currently use.  

Your Consent

By using our web sites, you consent to the collection, use and disclosure of your personal information and to the practices described in this Privacy Statement.  Without limiting the foregoing, we may on occasion ask you to consent when we collect, use, or disclose your personal information in specific circumstances, in which case we may ask for your consent in writing although in some circumstances we may accept your oral consent.  Sometimes your consent will be implied through your conduct with us if the purpose of the collection, use or disclosure is obvious and you voluntarily provide the information.  In addition, we may collect, use and disclose personal information without your consent when we are required or authorized by law to do so.

Retention of Personal Information

Personal Information will be retained in accordance with this Privacy Statement for as long as may be necessary or relevant for the purposes of collection, or as may be required or permitted by law, after which time it will be made anonymous or destroyed unless you further consent to its continued retention.

Changes to our Privacy Statement

We may from time to time revise this Privacy Statement with or without notice.  The revisions will be effective from the date of revision.  Please check the Privacy Statement each time you use our web sites for the most current information.
